Spousal Support
Spousal Support, or alimony, in California is generally intended to provide that each spouse be able, as near as possible, the life style that existed during the marriage. Temporary spousal support may be granted while a case is pending where there is a substantial discrepancy in income or where one spouse is unemployed. The Family Law Court will depend on wide variety of circumstance to determine what the amount of spousal support will be.
Alimony Payment Calculation
Spousal support calculations are generally much simpler than the final determination. This could be 40% of the primary income earners income less 50% of the spousal support recipients income. The final spousal support order will be dependant on a more detailed list of conditions that will include:
- Duration of the Marriage.
- Age and Health of each Spouse.
- Income and Employability of each Spouse.
- Expenses of each Spouse'
- Financial Management History of the Couple during the Marriage.
The court does have some discretion when interpreting the situation. However, this is no place for any emotional appeals. The Family Law Court in California is primarily concerned with achieving what the state considers an equitable division of your assets, providing for the care of minor children, and if deemed necessary, those of a spouse. What matters most is preparation in documenting the items stipulated by California family law, their proper presentation to the court and anticipating any challenges that may arise.
